1. Overview

Temporary protection (§ 24 AufenthG) is the residence permit granted to people displaced from

Ukraine on the basis of an EU Council decision under Directive 2001/55/EC. It is the only

German residence status whose duration is fixed collectively in Brussels rather than

individually by the Ausländerbehörde: § 24 Abs. 1 ties the permit to the protection period

measured under Articles 4 and 6 of the Directive (SRC-250). There is no individual protection

examination — registration and a permit, not a procedure.

It carries full labour-market access from day one, though not because § 24 says so: § 24 has no

employment clause at all (Absatz 6 is repealed), so the § 4a Abs. 1 default applies — employment

and self-employment alike, with no Zustimmung from the Bundesagentur für Arbeit (SRC-250,

SRC-132). It also sits inside the general benefit system rather than the asylum one: § 24 holders

are as a rule not listed in § 1 AsylbLG and so not excluded from SGB II by § 7 Abs. 1 S. 2 SGB II

(SRC-247, SRC-151). The trade-off is mobility — compulsory distribution across the Länder plus a

three-year Wohnsitzregelung on the first permit (SRC-250, SRC-241).

Extension runs by ordinance, not by appointment (SRC-254), leaving a card whose printed expiry

is earlier than its legal validity. This is the highest-volatility file in the directory: the EU

end date has moved repeatedly, a German ordinance must follow each move, and a federal law

changing the benefit system for later arrivals is pending but not yet in the statute text.

4.1 First issuance (P1)

The § 2 UkraineAufenthV exemption keeps a new arrival lawful for 90 days before any permit exists

(3.10, SRC-259). Distribution to a Land follows § 24 Abs. 3–4, then the permit comes from the

local Ausländerbehörde. In Berlin the application is online, the PDF confirmation itself certifies

lawful stay and the right to work until the appointment, and 5–6 weeks are quoted for the eAT

card (SRC-263).

4.2 Extension (P2)

Not an application. § 2 UkraineAufenthFGV extends every qualifying permit valid on the cut-off

date, conditions carried over (SRC-254). Keep the card together with the ordinance reference:

the printed expiry is earlier than the legal validity (PR2). As at 2026-08-26 the ordinance

reaches only 04.03.2027 while the EU decision reaches 04.03.2028 — the gap is OQ-1.

4.3 Transition out to a work or study title (P4/P5)

§ 24 is a protection title, not a qualification title, so a switch is a full new application on

the target provision's own conditions. Two underestimated risks: temporary protection and an

EU-directive authorisation cannot be held at the same time (SRC-260), and leaving § 24 means

leaving the benefit arrangement attached to it (3.18) — so do not surrender it before the new

title is granted.

4.4 End of temporary protection (P8)

When the protection period ends without extension, the permit ends with it (3.4, 3.27). The Council

Recommendation of 16.09.2025 asks Member States to promote transitions into other statuses before

the end, to inform people, and to run voluntary return programmes for about a year afterwards, with

legal residence continuing during enrolment (SRC-260) — a recommendation only, so nothing here

predicts what German law will provide (OQ-6).
