1. Overview

This status covers people whom the Bundesamt für Migration und Flüchtlinge (BAMF) has

recognised as needing protection, and who therefore hold a residence permit under § 25

Abs. 1 or Abs. 2 AufenthG. Three protection forms sit under one slug: constitutional asylum

(Asylberechtigung, Art. 16a GG → § 25 Abs. 1), refugee status (Flüchtlingseigenschaft →

§ 25 Abs. 2 Satz 1) and subsidiary protection (subsidiärer Schutz → § 25 Abs. 2 Satz 2).

The permit is an entitlement, not a discretionary decision: the statute says it *is to be

issued* once BAMF has recognised the person, and residence counts as lawful until the card

is actually issued (SRC-231).

Legal-architecture change (important). Since the EU Pact instruments applied, the

substance of refugee status and subsidiary protection is no longer in §§ 3–4 AsylG. § 3 AsylG

now only refers to Chapters III–VI of Regulation (EU) 2024/1347, and § 4 AsylG has been

repealed ("weggefallen"); § 25 AufenthG cites Art. 13 (refugee status), Art. 18 (subsidiary

protection) and Art. 23 Abs. 1 (family members) of that Regulation directly (SRC-231,

SRC-237, SRC-238). Any older guidance that says "§ 3 AsylG = refugee, § 4 AsylG = subsidiary"

is describing superseded law.

Practically, the status is strong: the permit runs for three years (all three protection

forms — SRC-236), the general issuance conditions of § 5 Abs. 1–2 AufenthG (secured

livelihood, passport, visa procedure) must be disregarded (SRC-167), full access to

employment and self-employment follows from § 4a Abs. 1 AufenthG (SRC-132), fees for

issuing and extending the permit are waived (SRC-246), and there is an entitlement to an

integration course (SRC-242). The two structural weak points are family reunification for

subsidiary protection holders (discretionary, capped — § 36a, SRC-211) and the BAMF

revocation check, which can reopen the whole status (SRC-239).

The status leads to a settlement permit: after five years — or three on the fast track —

for asylum and refugee status under § 26 Abs. 3 AufenthG, and only through the discretionary

§ 26 Abs. 4 route for subsidiary protection (SRC-236).

4.1 First issuance (P1)

Precondition: the BAMF Bescheid. The permit is an entitlement (3.2) and § 5 Abs. 1–2 are

disapplied (3.4), so neither secured livelihood nor a national passport may be demanded as a

condition. Residence is lawful in the gap between recognition and card issuance (3.3). No fee

(3.40). Duration: three years (3.5). Anmeldung, health insurance and Steuer-ID belong to the

universal layer and are not repeated as status conditions.

4.2 Extension (P2)

Apply before expiry so that § 81 Abs. 4 Fiktionswirkung attaches (3.8). Extensions run up to

three years each (3.6). The authority may not extend once the protection ground has ceased

(3.7) — in practice this is coupled to whether BAMF has notified a revocation ground under

§ 73b Abs. 3 AsylG (3.38). No fee, including for the Fiktionsbescheinigung (3.40).

4.3 Settlement permit (P5)

Asylum and refugee status: five years of permit possession with the preceding asylum-procedure

time credited, livelihood predominantly secured, A2 German, no BAMF revocation notice, plus

the § 9 Abs. 2 S. 1 Nr. 4–6, 8, 9 conditions (3.18). Fast track at three years with C1 German

and a far predominantly secured livelihood (3.19). Subsidiary protection holders are outside

§ 26 Abs. 3 and depend on the discretionary § 26 Abs. 4 route (3.20). Fee-exempt (3.40).

4.4 Revocation check (P8)

BAMF reviews withdrawal/revocation under § 73b AsylG and the two EU Regulations (3.36). The

sequence is: written notice of the intended decision with reasons → opportunity to respond,

possibly within one month → written, reasoned decision with Rechtsbehelfsbelehrung → if grounds

exist, notification to the Ausländerbehörde (3.38). A trip to the country of origin flips the

burden via the § 73b Abs. 1a presumption (3.27) — this is the single most damaging avoidable

action in this status.

4.5 Family reunification (P9/P10)

Asylum and refugee status: the three-month window from unappealable recognition converts the

discretionary waiver of livelihood and housing into a mandatory one (3.14) — the deadline is

also met by the sponsor's own timely application (§ 29 Abs. 2 S. 3). Subsidiary protection:

no entitlement, humanitarian discretion only, capped at 1,000 visas per month nationwide, with

the § 36a Abs. 3 exclusions (3.15–3.17).
