1. Overview

The Aufenthaltsgestattung is not a residence permit (Aufenthaltstitel). It is a statutory

permission to stay in the federal territory for the sole purpose of conducting the asylum procedure,

held by everyone whose asylum application is pending (§ 55 Abs. 1 AsylG). It is not "granted" on

application and cannot be renewed like a permit — it exists by operation of law for as long as the

right to remain under Regulation (EU) 2024/1348 exists, and lapses automatically when that right ends

(§ 67 AsylG). The card in the holder's pocket (§ 63 AsylG) only documents the status; before it is

issued the person holds an Ankunftsnachweis (§ 63a AsylG).

Because it is not a title, the Gestattung carries almost none of the entitlements users expect from a

permit. Movement is restricted to one Ausländerbehörde district at the start (§ 56 AsylG); work is

prohibited outright while the reception-centre obligation runs and otherwise needs an explicit

permission after a waiting period plus the consent of the Bundesagentur für Arbeit (§ 61 AsylG);

subsistence comes from the Asylbewerberleistungsgesetz at rates below SGB II and health care is

reduced to acute treatment (§ 4 AsylbLG). Family reunification and permanent residence are closed

off, and the time counts toward residence-duration rights only if protection is ultimately granted

(§ 55 Abs. 3 AsylG). The status is a waiting room with three exits: recognition, converting into a

permit under § 25 Abs. 1 or Abs. 2 AufenthG (continued in refugee_protection.md); rejection, which

makes the person enforceably obliged to leave and typically produces a Duldung under § 60a AufenthG —

a suspension of deportation, not a status; or transfer to another Member State under Regulation (EU)

2024/1351.

Legal-change volatility is exceptionally high. The AsylG and AufenthG texts now apply the

reformed Common European Asylum System: Regulations (EU) 2024/1348 (procedures), 2024/1347

(qualification) and 2024/1351 (responsibility — successor to the Dublin III Regulation). Benefit

rates change every 1 January by ministerial Bekanntmachung. Nothing here should be reused after the

next review date without re-fetching.

4.1 Distribution, release and residence conditions (P3)

The reception-centre duty ends early under § 48 AsylG (a duty to live elsewhere; recognition; a

statutory title entitlement arising from marriage or civil partnership) and must be ended under § 49

AsylG where a deportation warning is enforceable but removal is not possible within a reasonable time,

or where a § 24 AufenthG permit is to be issued. § 50 AsylG governs release and intra-Land

distribution: the assignment decision is written, needs no reasons and no hearing, but must respect

household unity and comparable humanitarian grounds. The Wohnsitzauflage is normally combined with

that decision (3.10, § 60 Abs. 3 AsylG) — SRC-229, SRC-223.

4.2 Work permission (P4)

Two regimes, routinely confused: inside the reception centre the starting point is a total prohibition

with a three-month exception (3.14); outside it, employment must be permitted after three months of

gestattet residence (3.16). Both need BA consent unless waived by regulation (3.18) and both yield to

the absolute bars in 3.17. Permission is an act of the authority — the waiting period elapsing does

not by itself make work lawful. Self-employment has no route (3.19).

4.3 Transitions INTO this status

Filing an asylum application creates the Gestattung by operation of law (§ 55 Abs. 1 AsylG) and

simultaneously destroys a visa exemption or any title valid up to six months (§ 55 Abs. 2 AsylG, 3.4)

— the most consequential and least understood step for anyone already holding a short-term status. A

Duldung holder who applies moves into the Gestattung, and the tolerated period counts toward the § 61

waiting period (3.16). Transfers to Germany under VO (EU) 2024/1351 enter by the same route.

4.4 Transitions OUT of this status

Recognition as entitled to asylum leads to a permit under § 25 Abs. 1 AufenthG; refugee status

(Art. 13 VO (EU) 2024/1347) and subsidiary protection (Art. 18) to § 25 Abs. 2 S. 1 Alt. 1 and Alt. 2;

a national deportation ban under § 60 Abs. 5 or 7 AufenthG to § 25 Abs. 3 AufenthG. Until the permit

is issued the stay counts as permitted (§ 25 Abs. 1 S. 3, Abs. 2 S. 3 AufenthG, SRC-231) — continued

in refugee_protection.md. Rejection makes the person enforceably obliged to leave; where deportation

is impossible in fact or law and no permit is issued it must be suspended and a Duldung certificate

issued (§ 60a Abs. 2, Abs. 4 AufenthG), which leaves the duty to leave untouched (Abs. 3) and lapses

on departure (Abs. 5). After an unappealable rejection or a withdrawal, a title may be issued before

departure only under Chapter 5 (humanitarian) of the AufenthG, with a further absolute bar in the

accelerated-procedure cases and §§ 18a, 18b, 19c Abs. 2 excluded (§ 10 Abs. 3 AufenthG, SRC-230).

Voluntary departure is the third exit; funding programmes are unverified (OQ-5).
