1. Overview

This status covers third-country nationals in Germany for a vocational training programme

(Ausbildung) or professional further training (Weiterbildung) under § 16a AufenthG. It has

two branches: qualified in-company training (betriebliche Berufsausbildung, § 16a Abs. 1 —

the classic dual Ausbildung with a training contract and an employer) and school-based

training (schulische Berufsausbildung, § 16a Abs. 2 — leading to a state-recognised

vocational qualification). The permit purpose can include a preparatory German language

course, in particular an occupation-related one.

The permit is tied to the concrete training. It allows a secondary job of up to 20 hours

per week alongside the training, but no self-employment. After successful completion the

holder can move to a skilled-worker permit (§ 18a AufenthG) with a qualified job, or take

a job-search permit (§ 20 Abs. 1 Nr. 3 AufenthG). Dropping out is status-threatening,

softened only by a statutory window of up to six months to find another training place

when the termination was not the trainee's fault (§ 16a Abs. 4).

Not to be confused with the Ausbildungsduldung (§ 60c AufenthG): that is a Duldung

(suspension of deportation) for tolerated persons who train in Germany — it is not a

residence permit and follows different rules. This file covers only the § 16a permit.

4.1 First issuance (P1)

Third-country nationals normally enter on a national visa for the training, then apply to

the local Ausländerbehörde. Preconditions: training contract, BA consent (§ 16a Abs. 1,

§ 39 — SRC-160, SRC-166), sufficient German (3.5), secured livelihood (3.16–3.17), health

insurance. Berlin fees: €100 initial eAT (€56 sticker); eAT takes 4–6 weeks to produce

(SRC-168).

4.2 Renewal / extension (P2)

Apply before expiry — in Berlin online only, at the earliest 4 months before the current

title expires (SRC-168). Filing before expiry triggers the Fiktionswirkung of § 81 Abs. 4,

keeping the stay lawful while the ABH decides (SRC-002); the ABH issues a

Fiktionsbescheinigung on request. Berlin renewal fees: €93 eAT / €49 sticker (SRC-168).

4.3 Transitions IN (P3)

Typical entry paths into RS-005: directly from abroad via national visa, or by purpose

change from a study permit (§ 16b — SRC-001) or another title. The purpose change is

decided by the Ausländerbehörde; the § 16a conditions (BA consent, language, financing)

must be met at that point.

4.4 Transitions OUT (P4, P5)

After successful completion: (a) § 18a AufenthG — permit for any qualified employment as a

skilled worker with the completed Berufsausbildung (SRC-162); or (b) § 20 Abs. 1 Nr. 3 —

job-search permit for up to 12 months, extendable once by up to 6 months, with further

extension excluded (SRC-145). Livelihood must be secured during the search.

4.5 Loss / dropout (P6)

If the training ends early for reasons outside the trainee's control, § 16a Abs. 4 grants

up to six months to find another training place before the permit is revoked or withdrawn

(SRC-160). Termination the trainee caused has no such protection — the permit purpose

lapses and the ABH decides on shortening the permit. Contrast: tolerated persons in

training hold an Ausbildungsduldung (§ 60c), which on early termination gives a six-month

Duldung for seeking a new training place (SRC-163) — different instrument, different

rules.

1. Federal confirmation of the financing figures. make-it-in-germany.com was unreachable (bot protection) on 2026-08-26. The €959/€992 monthly figures (3.17) rest only on the Berlin LEA page — a Level B federal cross-check is outstanding, and the figures may differ outside Berlin.
2. Concrete language level. § 16a requires "sufficient" German; the widely reported B1-in-practice threshold for visa issuance could not be verified against a Level A–C source this session.
3. Travel/Schengen. Re-entry and 90/180-day movement in other Schengen states with a German residence permit was not verified against an official source this session (3.15).
4. Work rights during the § 20 job-search permit. The scope of permitted Erwerbstätigkeit while searching could not be cleanly extracted from § 20; needs re-verification.
5. Purpose-change fee. A €98 fee for changing an existing permit to § 16a appeared in search results attributed to service.berlin.de but was not in the fetched page content — unconfirmed.
6. Vorrangprüfung for training consent. Whether BA consent for an Ausbildung involves a priority check under the current BeschV was not verified; § 39 Abs. 2 waives it for qualified employment, Abs. 3 retains it for other employment.
7. Statutory duration norm. § 16a itself fixes no permit duration; the duration-of-training rule (3.6) is Berlin practice. The governing federal norm (§ 7 Abs. 2 AufenthG / AufenthV) was not fetched.
8. School-based branch details. Whether BA consent and which financing rules apply to purely school-based training (§ 16a Abs. 2) needs closer reading of the statute text.
9. § 9 exclusion nuance. The fetched § 16a summary reported § 9 as inapplicable "unless the foreigner previously held a permit under §§ 18a/18b" — the exact sentence needs literal verification at source review.
