Purpose

Guide a third-country national holding a § 16b AufenthG study permit in Berlin who has completed or is nearly completing their degree, through switching in-country to a skilled-worker title (§ 18a or § 18b) or an EU Blue Card (§ 18g) — with the § 20 job-search permit as fallback when no qualifying job offer exists yet.

Ordered Steps

Step 1 — Confirm eligibility

Current permit is § 16b, applicant is registered in Berlin, and the degree is completed or close to it. If not close to completion, redirect to the renewal workflow.

Step 2 — Determine the target title

Step 3 — § 20 fallback

Available only after successful degree completion under § 16b. Up to 18 months; no extension by statute — once the clock runs out, the only way forward is a different title.

⚠ Correction: current § 20 AufenthG has only Abs. 1 (eligible groups, incl. Nr. 1 for § 16b/§16c graduates) and Abs. 2 (livelihood, 18-month duration, extension bar). There is no Absatz 3 — that wording is from an older version and no longer applies. Verified directly against gesetze-im-internet.de, 2026-08-28. Do not cite "§ 20 Abs. 3."

Step 4 — Resolve qualification recognition

Vocational qualifications run through the competent chamber/state authority (BIBB portal); foreign degrees need a ZAB comparability statement or anabin entry. Resolve before Step 6 — recognition delay is the most common cause of a stalled switch.

Step 5 — BA approval under § 39 AufenthG

Runs inside LEA's processing, triggered by the employer declaration (D-07) — not a separate applicant filing.

Step 6 — Submit the online application (in-country switch)

Holding a valid § 16b Aufenthaltserlaubnis independently satisfies § 39 Abs. 1 Nr. 1 AufenthV — no exit or fresh visa needed, and this Nummer carries no purpose restriction. (§ 39 Abs. 1 Nr. 3 AufenthV, which excludes § 16b claims, is a different provision for visa-exempt nationals with no prior German title — not applicable here.) Submit via the shared LEA form with the matching parameter= id (§18a: 305304; §18b: 329328; §18g: 324659; § 20: 324661).

Step 7 — Await review; Fiktionswirkung while pending

Filing before § 16b expires keeps the prior permit deemed valid under § 81 Abs. 3–4, documented by a Fiktionsbescheinigung; the confirmation PDF states the current title "remains valid beyond the previous validity date."

⚠ ASSUMPTION A-001 — unverified: this assumes Fiktionswirkung applies to a purpose change (study → employment) the same way it applies to a same-title renewal. Not separately confirmed with LEA for a cross-category switch (mirrors UQ-001 in student-residence-renewal-berlin.md).
