Provide informational guidance to a foreign national in Berlin whose residence-permit application (issuance or extension) is pending: what a Fiktionsbescheinigung is, which of the three § 81 AufenthG "fictions" applies to their situation, how to obtain the certificate from the Landesamt für Einwanderung (LEA), and how to use it safely with employers, landlords, and for travel — through to either the underlying decision or the certificate's own expiry.

Step 1 — Identify which § 81 fiction applies

⚠ If Duldungsfiktion applies, flag HIGH RISK: this is not the same legal position as the other two fictions and may affect work authorisation, travel, and time counted toward later permits. Escalate to LEA or an advisor before relying on it.

Step 2 — Understand what the certificate proves — and what it does not

• The Fiktionsbescheinigung is not itself a residence title; it documents the legal effect of having applied (SRC-002, SRC-009).
• It is valid only until LEA decides the underlying application (SRC-316).
• Under § 81 Abs. 4, conditions from the prior permit carry over automatically.
• Under § 81 Abs. 5a, whether gainful employment is permitted must be printed on the certificate itself (SRC-002) — this is the document to show an employer, not a separate letter.
• For online applications, some Berlin permit-type procedures issue a confirmation PDF at submission; this is evidence an application exists but is not the formal green Fiktionsbescheinigung card issued after the in-person appointment (SRC-009). ⚠ ASSUMPTION A-001 — unverified how consistently this applies outside the specific permit types already documented (see student/self-employed workflows).

Step 3 — Request, receive, and check the certificate

The certificate is issued on request, not automatically, and requires a personal interview at LEA. Processing occurs at/after that interview (SRC-009, SRC-316).

1. Confirm the underlying application is already filed — LEA will not issue a Fiktionsbescheinigung without one (SRC-009).
2. Attend the allocated appointment with all Required Documents; pay the fee unless exempt (D-05).
3. On receipt (a green folding card, the "förmliche Fiktionsbescheinigung", SRC-316), check the printed employment-permission wording ("Erwerbstätigkeit erlaubt" / "Beschäftigung erlaubt" / not permitted) against the user's actual work situation — this is the legally binding notation (SRC-002 Abs. 5a) — and check the printed review/expiry date (Step 6's trigger, not the date the underlying case will be decided).

Step 4 — Check travel and re-entry rules before booking anything

⚠ This distinction is the single highest-risk misunderstanding users have about this document. Always confirm the applicable fiction type (Step 1) before advising on travel. A valid German residence document generally also permits short Schengen-area travel of up to 90 days in any 180-day period without taking up work there, per general Schengen rules — but whether the Fiktionsbescheinigung itself supports crossing an external Schengen border for re-entry to Germany should still be confirmed with LEA case by case (SRC-153).

Step 5 — Use the certificate with employers and landlords

• Employer: point to the printed employment-permission line — § 81 Abs. 5a requires LEA to state this, so it is the authoritative proof, not a separate confirmation (SRC-002).
• Landlord: no official source addresses landlord acceptance specifically. ⚠ UNVERIFIED — treat any refusal as a practical/contractual issue, not a legal one; do not assert landlords are legally obligated to accept it (logged as UQ-004).

Step 6 — Monitor expiry and resolve

The certificate lapses on its printed review date even if LEA still has not decided the underlying case. If the decision is still pending as that date approaches, contact LEA before it lapses to have it re-issued or extended — a lapsed certificate with no decision yet is HIGH RISK; escalate immediately (renewal mechanics for the certificate itself are unresolved, UQ-002).

Completion Criteria

The workflow is complete when:

1. The user knows which § 81 fiction applies to their case and why, and holds (or has requested) the formal certificate with its employment-permission wording and review date checked.
2. The user knows, before booking any travel, whether re-entry is supported by their certificate type.
3. The user has a plan to renew/re-request the certificate if it lapses before the underlying decision.
4. The user knows the escalation path if the certificate lapses, is refused by a third party, or the underlying application is decided.
